Volunteer Release and Waiver of Liability and Related Attestations

PLEASE READ CAREFULLY. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS.

IF VOLUNTEER IS OF THE AGE BELOW 18, THE FORM SHOULD BE FILLED BY PARENT / GUARDIAN.

This Release and Waiver of Liability and Related Attestations (the “Release and Attestations”) executed by the “Volunteer” in favor of Farm Unity Limited (“Farm Unity”), a nonprofit corporation, and its directors officers, employees, and agents. The Volunteer desires to work as a volunteer for Farm Unity and engage in the activities related to being a volunteer for building the garden (the “Activities”). The Volunteer understands that the Activities may include physical labor, exposure to hazardous conditions, or other circumstances that may result in personal injuries. The Volunteer hereby freely, voluntarily, and without duress executes this Release and Attestations under the following terms:

  1. Release and Waiver. Volunteer does hereby release and forever discharge and hold harmless Farm Unity and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity that arise or may hereafter arise from Volunteer’s Activities with Farm Unity.

VOLUNTEER UNDERSTANDS THAT THIS RELEASE DISCHARGES FARM UNITY FROM ANY LIABILITY OR CLAIM THAT THE VOLUNTEER MAY HAVE AGAINST FARM UNITY WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE THAT MAY RESULT FROM VOLUNTEER’S ACTIVITIES WITH FARM UNITY, WHETHER CAUSED BY THE NEGLIGENCE OF FARM UNITY OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS OR OTHERWISE. VOLUNTEER ALSO UNDERSTANDS THAT FARM UNITY DOES NOT ASSUME ANY RESPONSIBILITY FOR OR OBLIGATION TO PROVIDE FINANCIAL ASSISTANCE OR OTHER ASSISTANCE, INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH, OR DISABILITY INSURANCE IN THE EVENT OF INJURY OR ILLNESS.

  1. Medical Treatment. Volunteer does hereby release and forever discharge Farm Unity from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Volunteer’s Activities with Farm Unity.
  2. Assumption of the Risk. The Volunteer understands that the Activities may involve work that may be hazardous to the Volunteer. Volunteer hereby expressly and specifically assumes the risk of injury or harm in the Activities, and releases Farm Unity from all liability for injury, illness, death, or property damage resulting from the Activities.
  3. The Volunteer understands that, Farm Unity does not carry or maintain health, medical, or disability insurance coverage for any Volunteer. Each Volunteer is expected and encouraged to obtain their own insurance coverage.
  4. Photographic Release. Volunteer does hereby grant and convey unto Farm Unity all right, title, and interest in any and all photographic images and video or audio recordings made by Farm Unity during the Volunteer’s Activities with Farm Unity, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
  5. Attestations – Farm Unity Policy re Firearms & Volunteer Safety: For the safety of all Volunteers, Farm Unity has adopted a policy that the premises may not be used by Volunteers while they are carrying firearms. Additionally, use of the Premises is restricted to those who have not previously been convicted of a sexual offense that requires listing by relevant authorities.  Volunteer expressly acknowledges its understanding of this policy and agrees not to bring any firearms on the premises.  Volunteer attests they are not bringing any weapons or firearms on to the premises where Activities are being performed.  Volunteer attests volunteer is not on any sexual offender lists.  In addition, Volunteer agrees to adhere to all policies of the owner of the premises.  Violation of this provision may result in termination of further use of the premises.
  6. Volunteer expressly agrees that this Release and Attestations are intended to be as broad and inclusive as permitted by the laws of the State of Maryland, and that this Release and Attestations shall be governed by and interpreted in accordance with the laws of the State of Maryland. Volunteer also agrees that in the event that any clause or provision of this Release and Attestations shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release and Attestations which shall continue to be enforceable.
